Cleveland Browns receiver Donte’ Stallworth has been charged with DUI manslaughter after he struck a man last month while driving his Bentley during the early morning hours in South Beach.

Stallworth’s blood alcohol content level was measured at .126, well over Florida’s legal limit of .08. ESPN.com reporting:

A Miami Beach police report said that Reyes was not in a crosswalk on busy MacArthur Causeway when he was struck by the black 2005 Bentley luxury car driven by Stallworth. The construction crane operator was trying to catch a bus home after finishing his shift about 7:15 a.m.

The report also quoted Stallworth as saying he flashed his lights at Reyes in an attempted warning and that Stallworth was driving about 50 mph in a 40-mph zone.

An additional police affidavit filed Wednesday said that on the morning of the crash, Stallworth was drinking at a club in the posh Fountainebleau hotel on South Beach. He left to go to a nearby home — it’s not clear if the home was one of Stallworth’s three Miami-area properties — hen headed out to the causeway where Reyes was struck.

ESPN ‘s Michael Smith has said that the case will be very difficult for prosecutors because they must prove that the fate of 59-year-old Mario Reyes was solely due to Stallworth’s blood alcohol content. In other words, Reyes not being in a crosswalk will likely cause a shift in the waters of the case.

On another note; would it really be too much trouble to catch a cab home? I mean, Stallworth lived close to where he was getting tanked that night; shall we walk? I simply can’t get over the fact that people are stupid enough to drink all night and then get behind the wheel of a car with no regard for anyone or anything. And when you think about Stallworth and his recently-signed $35 million contract, a cab was certainly affordable. And with all that money, you can buy a new friend to give you a ride. Think!
